Totnes Community Development Society (TCDS) as a qualifying body has prepared a submission for a Community Right to Build Order for Atmos Totnes, The Former Totnes Creameries Site, Totnes, TQ9 5JP for and with the local community.

TCDS is presenting the draft Order here as part of a six weeks pre-submission consultation programme, as per regulation 14 of the Neighbourhood Planning Regulations 2012.

What representations should be made at this point?
Comments on any aspect of the proposals are welcome and objections will be formally logged and responded to. Representations at this stage should also address whether or not the draft Community Right to Build Order meets the basic conditions and other matters that an independent examiner is required to consider under paragraph 8 of Schedule 4B to the Town and Country Planning Act 1990 (as amended). The Basic Conditions are that Totnes Community Development Society Community Right to Build Order for Atmos Totnes must:
- have appropriate regard to national policies and advice contained in the National Planning Policy Framework (NPPF);
- contribute to the achievement of sustainable development;
- be in general conformity with the strategic policies contained in the Local Plan for the area; and
- be compatible with EU obligations, including human rights requirements.
What happens next?
Following the end of the consultation, comments will be assessed and fed back into the ongoing design process led by Totnes Community Development Society. Objections to the plans will be reported and responded to. Depending on the modifications required, Totnes Community Development Society would aim to submit the Community Right to Build Order to South Hams District Council in 2016 for further consultation and review before proceeding to an independent examiner, and if appropriate, a referendum.
